He remains barred from playing for Brazil in all competitive and friendly matches, although he can continue to play club football for Real Madrid.
The world's best left-back was sent off during Brazil's friendly agianst Portugal on March 29 for pushing referee Alon Yefet of Israel.
FIFA, the body which governs world football, imposed the suspension on April 7 and Roberto Carlos appealed the next day.
But the chairman of FIFA's appeals committee, Guatemalan Rafael Salguero Sandoval, decided that the ban must remain until the case is dealt with by the body's disciplinary committee on May 9.
A FIFA statement said: "Having viewed the video recording of the match and having read the referee's report, the chairman of the FIFA Appeal Committee is of the opinion that there is sufficient evidence to support the provisional suspension, and that the regulations have been applied correctly. The player's appeal has therefore been rejected."
